We’re glad you’re here. These Terms of Use explain how Helix Seven works, what you can expect from us, and what we ask of you in return. Please read them carefully, as they contain important information about your rights and responsibilities.

We understand the importance of confidentiality and privacy regarding your information. The points below are an overview for convenience only. They do not modify, limit, or replace the full Terms. Your use of the Services is governed by the full Terms, including any additional terms provided by third parties.

Helix Seven does not provide medical advice and is not a medical provider. Instead, Helix Seven facilitates access to and helps individuals establish and maintain relationships with independent, third-party healthcare providers and affiliated medical groups through Open Loop Health. Helix Seven also provides certain non-medical administrative, technology, coaching support, and general wellness-related services and information only.

Clinical care is provided solely by independent, third-party affiliated medical groups and licensed healthcare providers. Providers solely make all medical determinations, including whether telehealth is appropriate, whether treatment is offered, and whether any prescription is issued.

Wellness coaching, educational content, and lifestyle guidance are non-medical. Coaching services, educational materials, and wellness guidance offered through Helix Seven are not medical care and are not a substitute for professional medical advice, diagnosis, or treatment.

Certain offers may include wellness tests, supplements, or wellness-related tools intended for general wellness use only. Any food sensitivity testing, wellness assessments, including Helix Seven powered by Advanced Food Intolerance Labs branded tests, supplements, or tools such as Body Composition Analysis scales (“BCA Scales”), are provided solely for informational and general wellness purposes. These offers are not medical devices, are not intended to diagnose, treat, cure, or prevent any disease, and do not replace professional medical advice, diagnosis, or treatment.

You may be routed to third-party clinical systems. Certain portals or pages may display Helix Seven branding but may be operated by affiliated medical groups, providers, laboratories, pharmacies, or their vendors, not by Helix Seven. Your personal health information is important to us and you can view how we use your personal health information on our Notice of Privacy Practices.

Labs and pharmacies are independent third parties. Laboratory services and prescription fulfillment, if required or approved by a provider, are performed by independent third-party laboratories and pharmacies, not by Helix Seven.

Additional terms apply. Your relationship with affiliated medical groups, providers, labs, pharmacies, coaches, testing providers, or supplement vendors, and your use of their services or portals, is governed by their respective terms, policies, and notices, even if the Helix Seven branding appears.

Availability varies by jurisdiction. Certain services, programs, tests, supplements, or program features may not be available in all states or in Washington, D.C., and availability may change at any time.

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of Helix Seven LLC’s websites, applications, digital interfaces, tools, and related services (collectively, the "Services"). Helix Seven LLC is referred to as "Helix Seven," "we," "us," or "our."

By accessing or using the Services, or by clicking to accept these Terms where offered, you agree that:

1.   you accept and agree to these Terms; and

2.   you will comply with all rules, policies, and notices posted on or referenced by the Services.

All references to "you" or "your" mean the person who accesses or uses the Services. If you use the Services on behalf of an entity or another person, you represent you have authority to bind them. Your acceptance of the Terms will be deemed an acceptance by that entity or individual, and “you” and ”your” herein shall refer to that entity, its directors, officers, employees, and agents.

PLEASE READ THE TERMS THOROUGHLY AND CAREFULLY. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE AND THE OTHER TERMS AND POLICIES REFERRED TO HEREIN, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. ANY ADDITIONAL, DIFFERENT OR CONFLICTING TERMS AND CONDITIONS ON ANY DOCUMENT, NOTICE OR COMMUNICATION ISSUED BY YOU TO HELIX SEVEN AT ANY TIME ARE HEREBY OBJECTED TO AND REJECTED BY HELIX SEVEN, SHALL BE WHOLLY INAPPLICABLE TO YOUR ACCESS TO AND USE OF THE SITE, AND SHALL NOT BE BINDING IN ANY WAY ON HELIX SEVEN.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use and to the other terms and policies referred to herein (including, without limitation, the Privacy Policy) (the “Additional Terms”) at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms of Use or the “Last Updated” date of such Additional Terms, as the case may be, and, except to the extent prohibited by mandatory applicable law, you waive any right to receive specific notice of each such change. It is your responsibility periodically to review these Terms of Use and the Additional Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use and in any revised Additional Terms by your continued use of the Site or Services after the date such revised Terms of Use or revised Additional Terms, as the case may be, are posted. If you disagree with these Terms of Use or any Additional Terms, your sole and exclusive remedy is to discontinue your use of the Site or Services.

2. Definitions

For purposes of these Terms:

“Affiliated Medical Groups” means independent, third-party professional medical organizations that provide clinical services.

“Providers” means licensed clinicians contracted with or employed by Affiliated Medical Groups.

“Healthcare Provider Sites” means clinical portals or systems operated by Affiliated Medical Groups, Providers, or their service providers.

“Third-Party Suppliers” means third-party pharmacies, laboratories, and other suppliers that may provide prescription fulfillment or lab services.

“Helix Seven Content” means text, graphics, videos, audio, photographs, illustrations, graphics, and other materials made available by Helix Seven through the Services.

"Program" means the Helix Seven offering selected by the customer, including recurring care access, wellness support, and included program benefits where applicable.

"Subscription" means the recurring billing arrangement associated with an eligible Helix Seven Program.

3. The Helix Seven Services 

THE SERVICES ARE FOR INFORMATIONAL, ADMINISTRATIVE AND GENERAL WELLNESS PURPOSES ONLY. HELIX SEVEN DOES NOT PROVIDE MEDICAL OR HEALTHCARE ADVICE.

3.1 Our Role

Helix Seven is not a healthcare provider and does not practice medicine, nursing, or pharmacy. Depending on your location and the services offered, Helix Seven may provide:

access to general information or products related to general health and wellness;

technology and administrative support to help you connect and establish a relationship with independent, third-party Affiliated Medical Groups and Providers;

non-clinical support services (such as scheduling, account support, and general navigation of the Services);

coordination support for third-party laboratory services, if required by a Provider; and

coordination support for third-party pharmacy fulfillment if a Provider issues a prescription.

Helix Seven does not control or interfere with the practice of medicine by Providers or Affiliated Medical Groups through Open Loop Health. Providers are solely responsible for the medical care and treatment they provide.
Helix Seven utilizes third-party technology and administrative service providers to facilitate connections with the independent Affiliated Medical Groups and Providers. These entities operate independently and are solely responsible for clinical services, patient management systems, medical decision-making, and care delivery. Helix Seven does not control, direct, or influence clinical decisions, provider–patient interactions, prescriptions, treatment plans, or medical operations.

3.2 No Provider–Patient Relationship with Helix Seven

You understand and agree that using the Services does not create a doctor–patient relationship (or other healthcare provider–patient relationship) between you and Helix Seven. Any provider–patient relationship is solely between you and the applicable Provider and/or Affiliated Medical Group.

3.3 No Reliance

Helix Seven Content is provided for informational purposes only and is not professional medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional for questions about your health. Reliance on information obtained through the Services is at your own risk.

3.4 No Guaranteed Results
Individual outcomes vary. Helix Seven does not guarantee weight loss, body composition changes, symptom improvement, metabolic response, medication tolerance, or any specific health outcome through use of the Services, any affiliated Provider, any prescribed treatment, or any wellness-related offering made available through Helix Seven.

By enrolling in a Helix Seven Program, you are purchasing access to a non-clinical membership program that includes administrative support, technology access, and wellness-related services. Any clinical services, including consultations, treatment decisions, prescriptions, laboratory services, or pharmacy fulfillment, are provided separately by independent third-party Affiliated Medical Groups, Providers, laboratories, and pharmacies. Payment to Helix Seven does not guarantee that you will receive medication, a prescription, or any specific clinical outcome.

4. How the Services Work

To determine eligibility for certain offerings, you may be asked initial qualifying questions. Those questions are intended to help route you to appropriate clinical resources.

If you meet criteria set by our Affiliated Medical Group, you may be invited to schedule an appointment and create an account on a Healthcare Provider Site (a "Patient Portal"). The Patient Portal may display Helix Seven branding, but it may be operated by the Affiliated Medical Group, Provider, or their vendors—not Helix Seven.

Clinical intake forms, medical questionnaires, clinical evaluations, diagnoses, prescriptions, and any provision of telehealth occur through Healthcare Provider Sites and are provided by Providers—not Helix Seven.

Your diagnosis or treatment may require lab work or prescription fulfillment provided by Third-Party Suppliers.

Your use of Healthcare Provider Sites and Third-Party Suppliers may be governed by additional terms, consents, notices, or policies provided by those third parties.

5. Telehealth Limitations; Independent Medical Judgment 

Telehealth services (if offered) are provided by Providers affiliated with independent Affiliated Medical Groups. Providers exercise independent professional judgment when evaluating you. Not all conditions are appropriate for telehealth.

Providers may determine that:

an in-person visit is required;

lab testing is required;

a referral to another clinician or facility is appropriate;

no prescription or treatment is clinically appropriate; or

services are not available for your location or circumstances.

There is no guarantee that you will receive a prescription or any particular outcome.

6. State Coverage

Helix Seven currently facilitates services in all 50 U.S. states and Washington, D.C. subject to provider availability, pharmacy licensing, laboratory access, and applicable state requirements. Certain services, medications, laboratory options, tests, supplements, programs, or program features may not be available in every jurisdiction and availability may change at any time without notice.

7. Additional Terms and Third-Party Services 

Certain services may require you to agree to additional terms, consents, assignments, releases, or notices ("Additional Terms"). In many cases, Helix Seven is not a party to those Additional Terms and you will enter into them with a third party (such as an Affiliated Medical Group, Provider, pharmacy, or lab). You agree to comply with any applicable Additional Terms.

7.1 Pharmacy Services (Third-Party)

By using the Services, you acknowledge and understand that Helix Seven is not a pharmacy and does not control or interfere with pharmacy services. Prescription fulfillment is performed by third-party pharmacies. By accepting these terms you understand and acknowledge that you may be entering into a relationship with a pharmacy, and/or pharmacy group or other such relationship with any one or more such third-party entities.

Pharmacy partners may change from time to time. Patients should not contact pharmacies directly unless instructed by their Provider. Helix Seven does not guarantee the use of any specific pharmacy. Pharmacy assignment depends on provider decision, availability, state licensing, fulfillment timelines, inventory, and operational requirements.

7.3 No Guaranteed Timelines
Any timeframes referenced by Helix Seven in connection with consultations, prescriptions, medications, wellness tools, fulfillment, or shipping are estimates only and are not guaranteed. Delays may occur due to provider availability, clinical review, pharmacy processing, shipping carriers, or other third-party factors outside of Helix Seven’s control.

8. Eligibility and Account Creation

The Services are intended for U.S. residents who are at least 18 years old and who have the legal right, authority, and capacity to enter into these Terms. Some offerings may have additional eligibility requirements. Please contact us at hello@helixseven.com if you are a parent or legal guardian of an individual under the age of eighteen (18) who you believe has used the Services without your consent.

You may be required to create an account. You agree to provide accurate information and keep it updated. You are solely responsible for safeguarding your login credentials and for all activity that occurs under your account. Helix Seven will not be liable for unauthorized use of your account, and you may be liable for losses, damages, liability, expenses, and attorney's fees incurred by Helix Seven or a third party arising from someone else using your Account due to your conduct regardless of whether you have notified us of such unauthorized use. 

You understand and agree that we may require you to provide information that may be used to confirm your identity and help ensure the security of your Account. By creating an Account, you represent and warrant that any information to create your Account is accurate, current, and complete information, and you further agree to update the information in your Account to keep it accurate, current, and complete.

If you believe your account has been compromised, notify us promptly at hello@helixseven.com.

We may suspend or terminate accounts to protect users, Providers, Affiliated Medical Groups, or the Services. If Helix Seven has previously prohibited you from accessing or using the Services, you are not permitted to access or use the Services. We also reserve the right to disable or close any Account at any time and for any reason or for no reason.

9. Privacy and Health Information

We understand the importance of confidentiality and privacy. Please refer to our Notice of Privacy Practices Policy for information about how we collect, use, and disclose health-related information about you. You authorize us to collect, use, disclose and otherwise handle your personal information as set forth in our Notice of Privacy Practices Policy, which we may modify from time to time.

Helix Seven may collect information you provide to help facilitate access to Providers and coordinate services. Some information may be considered protected health information under applicable laws when handled by Providers, Affiliated Medical Groups, pharmacies, or labs.

You consent to Helix Seven sharing information you submit with Affiliated Medical Groups, Providers, and Third-Party Suppliers as necessary to facilitate requested services, including prescriptions and lab services.

10. Fees & Payments

Your membership in the subscription program (“Subscription Service”), including your ability to access the services, begins when you have completed the intake form at which time you will be charged for the first month of the Subscription Services.

Pricing is displayed transparently at checkout. Charges may appear on your payment statement as: OPL-Helix Seven. Certain Helix Seven programs are billed on a recurring subscription basis (“Subscription Services” and “Subscription Fee”). Subscription pricing, billing frequency, and applicable taxes or fees will be disclosed at checkout.

BY ENTERING YOUR CREDIT CARD INFORMATION AND SUBMITTING YOUR REQUEST YOU AUTHORIZE US, OUR AFFILIATES, OR OUR THIRD-PARTY PROCESSORS TO RETAIN CREDIT CARD INFORMATION WHICH WILL BE KEPT ON FILE TO BE USED AS A FORM OF PAYMENT FOR, BUT NOT LIMITED, TO FEES, CO-PAYS, CO-INSURANCE, DEDUCTIBLES, LATE CANCELATIONS, MISSED APPOINTMENTS, RETURNED CHECKS, FAILED PAYMENTS, PAST DUE BALANCES, FEES ASSOCIATED WITH SUBSEQUENT MEDICAL SERVICES AND/OR "SUBSCRIPTION SERVICES" AS DEFINED BELOW. 

It is your responsibility to review the pricing, Subscription Fee, Program billing terms, included services, and any applicable taxes disclosed at checkout. Medication is prescribed only if approved by a licensed clinician. Pricing is presented transparently during checkout, and charges for eligible services are collected through the payment transaction as disclosed through the Services. Clinician approval, treatment eligibility, and prescription issuance are determined independently by the Provider and are not guaranteed by payment alone.

Your Subscription will automatically continue at the billing interval indicated at registration for your selected program, and we (or our third-party payment processor Stripe) will automatically charge at the beginning of each new Subscription period commencing after the initial Subscription period for your Subscription, using the Payment Information you have provided, unless prior to the end of the current Subscription period, (a) you cancel your Subscription (as described below); (b) we decline to renew your Subscription; or (c) these Terms are otherwise properly terminated as expressly permitted herein. We may receive updated credit card information (new credit card number or updated expiration date) from your credit card issuer. We may use these new details in order to help prevent any interruption to the Services. If you would like to use a different payment method or if there is a change in payment method, please contact us at support@helixseven.com

Subscriptions may include additional terms and conditions as may be described at the time of purchase or in other communications we send to you. The Subscription Fee is non-refundable except as expressly set forth in these Terms or in accordance with applicable law. If any Subscription Fee is not paid in a timely manner, or your transaction cannot be processed, we reserve the right to suspend, disable, cancel or terminate your access to the Services or cancel your Subscription. You will be responsible for paying all past due amounts.

10.1 Non-Refundability

Except where required by law or expressly stated in writing by Helix Seven or in these Terms, payments are non-refundable and final. Helix Seven may consider refunds on a case-by-case basis and decisions on refund requests are in the sole discretion of Helix Seven. EXCEPT AS EXPRESSLY PROVIDED HEREIN, YOUR PURCHASE IS FINAL AND YOU WILL NOT BE ABLE TO CANCEL THE PURCHASE AND/OR RECEIVE A REFUND OF YOUR SUBSCRIPTION FEE AT ANY TIME UNLESS REQUIRED BY LAW, EXPECT AS OTHERWISE STATED IN THESE TERMS BELOW. Please see Cancelation and Refunds below.

10.2 Failed Payments

If a payment cannot be processed, is declined, is reversed, or remains unpaid, we may suspend, delay, restrict, or cancel your access to the Services, and you remain responsible for any outstanding amounts due.

10.3 Lab Work 

For some customers, lab work is required prior to the initial consultation. Customers may obtain required lab work from their primary care physician or through our third-party vendor, where applicable. If required labs are not provided or the customer is unable to complete required labs through a third-party vendor, the customer is not eligible for a refund on that basis alone. If the customer fails to schedule and attend the initial consultation within three (3) months of agreeing to these Terms, any opportunity for a refund may be terminated.
Helix Seven does not accept government insurance and does not work with government insurance companies at this time. Certain Programs may have additional eligibility requirements, including age requirements, refill questionnaires, laboratory review, or clinical reassessment. Helix Seven reserves the right to change policies surrounding multi-month prescriptions at any time.

10.4 Program Benefits; BCA Scale, VIP Access, and Helix Seven Wellness Tests 

Certain active programs may include access to one or more non-clinical program benefits, including a Body Composition Analysis Scale (“BCA Scale”), access to the VIP Helix Seven Online Community, and Helix Seven wellness tests powered by Advanced Food Intolerance Labs ("AFIL") These benefits are offered as program-related wellness benefits only and are not medical treatment, diagnosis, or healthcare services. Program benefits, including wellness tests, community access, coaching, and physical products, are included as part of the overall Program and have no separate cash value. Failure to use, claim, or access any benefit does not entitle you to a refund, credit, or partial refund.

BCA Scale
Where included, the BCA Scale may become available after initial clinical approval and activation of an eligible medication program. Eligible customers may be required to claim shipment through their Helix Seven account, patient portal, email communications, text communications, or other instructions provided through the Services. Helix Seven covers standard shipment costs for the BCA Scale where included as part of an eligible program unless otherwise stated. Shipment timing may vary based on fullfilment operations, customer eligibility, account status, inventory availability, and response to claim instructions. Once shipped, fulfilled, or otherwise processed, the BCA Scale is non-refundable and non-redeemable for credit except where required by law or where Helix Seven determines otherwise in writing.

VIP Helix Seven Online Community
Access to the VIP Helix Seven Online Community is provided for educational, motivational, and general wellness support purposes only. Community access does not constitute medical advice, diagnosis, treatment, or a provider-patient relationship. Helix Seven may suspend, remove, modify, or discontinue community access at any time. Community access may be removed if you are no longer an active customer for more than six (6) months.

Helix Seven Wellness Tests ("Food Sensitivity, Vitamins & Gut Health")
Where included, Helix Seven wellness tests powered by Advanced Food Intolerance Labs are offered for informational and general wellness purposes only. These non-diagnostic tests are not intended to diagnose, treat, cure, or prevent any disease and do not replace professional medical advice, diagnosis, or treatment.
Eligibility for release of these wellness tests is based on continued program progression, active customer status, completed qualifying payments, and clinical suitability as determined through the Services. Because treatment plans vary, including where a Provider recommends dosage adjustments, delayed refills, extended medication use, or temporary pauses in ordering, eligibility timing may differ between customers. Temporary pauses, delayed refill cycles, larger prescribed dosages, or clinically directed treatment adjustments may delay the timing at which a wellness test becomes available without affecting overall eligibility, provided the customer remains in good standing and continues participation within the program.
Eligible customers may be required to claim or activate access to the wellness test through their Helix Seven account, patient portal, email communications, text communications, or other instructions provided through the Services.
Unless expressly stated otherwise through the Services, Helix Seven wellness tests powered by Advanced Food Intolerance Labs do not include a collection kit. Customers may be required to provide and use ordinary household collection materials to collect a hair sample, including but not limited to a small clean plastic bag, envelope, or similar household collection materials. Customers are responsible for arranging and paying any required postage or mailing costs to return samples to the designated wellness laboratory processing address communicated through the Services located in the US.
Helix Seven reserves the right to determine when program benefits are released, fulfilled, delayed, suspended, modified, or withdrawn. Advanced Food Intolerance Labs and any related testing provider may require acceptance of separate terms, policies, notices, or instructions governing sample submission, laboratory processing, result delivery, and related services. Your use of those services is subject to the applicable third-party terms in addition to these Terms.

Program Changes
Helix Seven reserves the right to substitute, modify, replace, delay, suspend, or discontinue any non-clinical program benefit, including BCA Scales, VIP community access, and wellness tests, or other offered materials and tools where reasonably necessary for operational, supply, fulfillment, legal, compliance, or business reasons.

Program benefits that become available but remain unclaimed, unused, incomplete, expired, or unreturned do not create any entitlement to a refund, partial refund, account credit, or substitution unless expressly required by law or approved by Helix Seven in writing. Payment is collected at the time of enrollment for access to the Helix Seven Program and associated administrative and wellness services. Clinical eligibility, treatment decisions, and prescription approval are determined independently by a licensed Provider after enrollment. Payment does not guarantee that you will be approved for treatment or receive medication.If a Provider determines you are not eligible prior to any clinical services or fulfillment, you will receive a full refund as described in these Terms. You acknowledge that your purchase of a Helix Seven Program is a commercial transaction for access to a bundled set of services and benefits, and is not contingent upon any specific clinical decision, prescription, or health outcome.

11. Cancellations & Refunds of Subscription Services

11. Cancellation for Subscriptions Services
You may cancel your recurring Helix Seven program at any time for any reason by following the cancellation instructions available through your Helix Seven account, patient portal, or by contacting support@helixseven.com.
Cancellation stops future recurring billing but does not create entitlement to a refund for prior charges, shipped medication, completed consultations, fulfilled services, released program benefits, or third-party services unless expressly stated in these Terms or required by law.
If a cancellation is submitted after a billing cycle has begun, access to eligible non-clinical services may continue through the remainder of that billing period unless otherwise restricted by clinical, operational, or legal requirements.

11.1 Timing of Cancellation

Cancellation applies to future billing periods only and does not entitle you to a refund for the current billing period unless required by law.To avoid the next recurring charge, cancellation must be submitted at least seventy-two (72) hours before your next scheduled billing date. If cancellation is submitted fewer than seventy-two (72) hours before renewal, the next recurring charge may still be processed and may not be refundable unless required by law.

11.2 Cancellation Due to Disqualification at Sign-Up

If a licensed Provider determines during initial review that you are not clinically eligible for treatment before medication is prescribed or dispensed, or any third-party fulfilment begins, you will receive a full refund of the amount paid at sign-up.

11.3 Cancellation Due to Eligibility Changes During Treatment

If clinical eligibility changes after care has begun, including where new laboratory findings, updated medical history, or provider judgment indicate that treatment should not continue, cancellation may take effect immediately. Refunds are limited to the current billing period where applicable and do not apply to medication already dispensed, prior consultations, fulfilled services, shipped items, or prior billing periods. Program benefits already released, activated, claimed, or made available remain non-refundable.

11.4 Cancellation for Appointments with Providers

If a cancellation request is received at least twenty-four (24) hours before your scheduled appointment with Affiliated Medical Groups or Providers, no late cancellation fees will be assessed. If a cancellation request is received within twenty-four (24) hours of your scheduled appointment then a cancellation fee may apply up to the amount of applicable appointment or program fee. This fee is separate from your fee for your chosen program. Fees for missed appointments and late cancellations will be charged to your card on file automatically. Refunds for exceptional circumstances may be offered on a case by case basis, and it is at Helix Seven’s, our partner Provider's, and Affiliate Medical Group's sole discretion.  

11.5 Termination of Subscription by Helix Seven 

We may suspend or terminate access to all or part of the Services where reasonably necessary for legal, operational, safety, compliance, fraud prevention, payment, or policy reasons. If we cancel your Subscription, we may give you a prorated refund based on the amount of time remaining that you cannot use, provided, however, that we will not be obligated to grant you a refund if we terminate your Account or your Subscription because we determine, in our sole discretion, that your actions or your use of the Services violates these Terms or any applicable law or has harmed another user.

11.6 Changes to Subscription Terms

We may change the Subscription terms or Subscription Fees at any time on a going forward basis at our discretion. If the pricing for your Subscription increases, we will notify you, and provide you an opportunity to change your Subscription before applying those changes to your Account or charging you in connection with an automatic renewal. We may choose in our sole discretion to add, modify, or remove benefits and features from a Subscription. Your continued use of the Services after the changes become effective will constitute your acceptance of the changes. If you do not wish to continue subscribing with the new fees or features, you may cancel your Subscription. If you accept the new Subscription, its terms and conditions will apply for that renewal and all renewals going forward.

11.7 Discounts and Promotions

From time to time, we may offer some users trial, discounted, or other promotional Subscription Fees. By participating in a promotional offer, you agree to the additional terms included with the promotional offer. Such trial or promotional programs or offers are subject to these Terms except as otherwise stated in the promotional offer, including which users are eligible for the promotional programs or offers. Only one trial or promotional program is available per household and may not be combined with any other promotion, except as otherwise stated in the promotional offer. If your Subscription is ever canceled or terminated for any reason, and you purchase an additional Subscription, you may not be eligible to take advantage of another promotional rate offer. If your Subscription includes a discount or promotional rate, you will be charged the promotional rate for the relevant number of Subscription periods, and upon completion of the promotional period, your Subscription will continue to automatically renew at the then-current Subscription Fee. To cancel and avoid being charged the full rate, you must notify us before the discount or promotional period ends. Please note that we do not provide price protection or refunds in the event of a price drop or promotional offering.

11.8 Termination Rights & Federal Law
Helix Seven its Providers or Affiliate Medical Group reserves the right to suspend, restrict, or terminate access to any part of the Services where misuse, abuse, policy violations, payment failure, provider non-compliance, fraud concerns, safety concerns, or legal obligations require such action.

Federal law generally prohibits the return of prescription medications to pharmacies for refund or reuse once they have been ordered to a patient in order to protect public health and safety. This policy ensures that all medications provided are handled and dispensed with utmost care and compliance. If approved, refunds will only be issued for your most recent billing cycle and will not be issued for past billing cycles.

11.8 Refunds for Damaged or Incorrect Items
Please inspect medication immediately upon receipt. If medication appears damaged, compromised, or incorrect, contact support@helixseven.com as soon as possible and provide photographs where requested. Damaged or incorrect medication replacement decisions are made by the dispensing pharmacy in accordance with pharmacy policy, applicable law, and product eligibility.
Damaged items: Damaged items may be replaced by the pharmacy upon receipt of evidence of damage.
Incorrect items: Incorrect medications will be replaced by the pharmacy.

12. Testimonials

By submitting testimonials, reviews, comments, before-and-after experiences, photographs, videos, or similar materials to Helix Seven, you grant Helix Seven a non-exclusive, royalty-free, worldwide right to use, reproduce, adapt, publish, display, and distribute such materials for marketing, educational, operational, and promotional purposes.

Any content submitted through the Services must not violate law, infringe intellectual property rights, contain false medical claims, impersonate others, or interfere with operation of the Services.

Testimonials reflect individual experiences only and do not guarantee that other customers will achieve similar outcomes.

13. Proprietary Rights; License

The Services and Helix Seven Content are owned by Helix Seven and its licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, Helix Seven grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit the Services or Helix Seven Content except as expressly permitted by these Terms.

14. Rules and Prohibited Conduct

You agree not to use the Services in any manner that is unlawful, harmful, or inconsistent with these Terms. Without limitation, you agree you will not:

create multiple accounts or misrepresent your identity;

engage in fraud, harassment, defamation, or infringement;

violate applicable laws or regulations;

introduce malware or attempt to compromise or interfere with security;

scrape, crawl, or access the Services using automated means without written permission;

reverse engineer systems or attempt to extract source code;

probe, scan, or test platform vulnerabilities;

interfere with or disrupt the Services;

use the Services to build a competing product or service;

submit false clinical information;

manipulate provider decisions;

misuse promotions, offers, or programs.

We may investigate suspected violations and cooperate with law enforcement as appropriate.

15. Copyright (DMCA) Notice

Your notice must include information required by the DMCA, including identification of the copyrighted work, the allegedly infringing material, contact information, a statement of good-faith belief, and a statement under penalty of perjury.

If you believe copyrighted material available through the Services infringes your rights, written notice may be sent to the designated legal contact listed below.

16. Communications & SMS

16.1 Electronic Communications

By providing your contact details, you consent to receive operational, billing, account, educational and support communications from Helix Seven electronically, including by email, SMS, phone, in-app messages, or other electronic methods. You agree that electronic communications satisfy any legal requirement that communications be in writing. You can opt out at any time by unsubscribing from the communications. Please note if you unsubscribe from important communications you may not receive important information in relation to your account or treatment plan.

16.2 SMS Messaging

If you opt in to SMS, you consent to receive recurring messages, which may include account notices, appointment reminders, and marketing messages, depending on what you sign up for. Message frequency may vary. Standard carrier and message rates may apply.

You can opt out of SMS any time by replying STOP. You may opt out of electronic communications by clicking unsubscribe at the footer of any email.

Please note that important service, billing, legal, safety, and account communications may still be sent where necessary.

Helix Seven and Carriers are not liable for delayed or undelivered messages.

17. Third-Party Content and Links

Helix Seven may rely on third-party systems, portals, pharmacies, laboratories, payment processors, communications tools, or software providers. Helix Seven is not responsible for interruptions, errors, delays, or independent actions caused by third-party systems outside its direct control. Helix Seven does not control and is not responsible for third-party services. Your use of third-party services is at your own risk and subject to their terms.

18. Duration and Termination

These Terms remain in effect while you access or use the Services and continue until terminated by either you or Helix Seven.

Helix Seven may suspend or terminate your access to the Services at any time, with or without notice, to comply with law, protect users, Providers or Affiliated Medical Groups, or address misuse. Certain provisions, including payment obligations, disclaimers, limitation of liability, dispute resolution, arbitration, and intellectual property protections, survive termination.

19. Indemnity and Release

You agree to indemnify, defend, and hold harmless Helix Seven, its affiliates, officers, directors, employees, contractors, agents, providers, laboratories, pharmacies, and service partners from any claims, damages, losses, liabilities, costs and expenses (including attorneys’ fees) arising out of or related to your use or misuse of the Services, breach or violation of these Terms, inaccurate submissions, unlawful conduct, or violation of law.

To the maximum extent permitted by law, you release Helix Seven and its representatives from claims arising out of disputes between you and third parties (including other users, Providers, pharmacies, or labs).

20. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, HELIX SEVEN PROVIDES THE SERVICES AND CONTENT ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HELIX SEVEN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

HELIX SEVEN DISCLAIMS LIABILITY FOR ACTS OR OMISSIONS OF THIRD PARTIES, INCLUDING SERVICE PROVIDERS, AFFILIATED MEDICAL GROUPS, PHARMACIES, AND LABS.

HELIX SEVEN DOES NOT GUARANTEE MEDICATION APPROVAL, CLINICAL ELIGIBILITY, SPECIFIC HEALTH OUTCOMES, SHIPPING SPEEDS, THIRD-PARTY AVAILABILITY, OR CONTINUED ACCESS TO ANY PARTICULAR PROVIDER, PHARMACY, LABORATORY, OR PROGRAM BENEFIT.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELIX SEVEN SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES, INCLUDING LOST PROFITS OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

HELIX SEVEN’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID HELIX SEVEN IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

22. Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY; IT MAY SIGNIFICANTLY AFFECT YOUR RIGHTS.

22.1 Informal Dispute Resolution

Before starting arbitration, you and Helix Seven agree to try to resolve disputes informally. You must send a written description of the dispute and the relief sought to hello@helixseven.com. We will attempt to resolve the matter in good faith. Any applicable deadlines or limitation periods are tolled while the parties engage in informal resolution.

If the dispute is not resolved within sixty (60) days after receipt of the notice, either party may commence arbitration.

22.2 Mutual Arbitration Agreement

You and Helix Seven agree that any claims or disputes arising out of or relating to these Terms or the Services will be resolved exclusively through binding arbitration under the Federal Arbitration Act.

An arbitrator—not a judge or jury—will decide the dispute. The arbitrator may award relief only on an individual basis.

22.3 Class Action Waiver

You and Helix Seven agree that arbitration (and any proceeding) will be conducted only on an individual basis. No class, collective, representative, or private attorney general actions are permitted.

22.4 Exceptions

Either party may bring qualifying claims in small claims court. Either party may seek injunctive or equitable relief to protect intellectual property or confidential information.

22.5 Arbitration Location

If you are a U.S. resident, arbitration will occur in the county where you reside unless the parties agree otherwise. Hearings may occur by video conference when appropriate.

23. Governing Law; Venue

Except to the extent disputes must be arbitrated under Section 22, these Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules or principles.

For disputes not subject to arbitration or small claims, you agree to the exclusive jurisdiction of state and federal courts located in Kansas, and you consent to service of process by mail.

24. General Terms

24.1 Entire Agreement

These Terms and any Additional Terms incorporated by reference constitute the entire agreement between you and Helix Seven regarding the Services.

24.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Failure to enforce any provision does not waive future enforcement rights.

24.3 Assignment

Helix Seven may assign these Terms in connection with a merger, acquisition, or sale. You may not assign your rights without Helix Seven’s written consent.

24.4 Statute of Limitations

To the extent permitted by law, any claim arising out of or relating to the Services or these Terms must be brought within one (1) year after the claim arose, or it is permanently barred.

24.5 Updates

We may update these Terms from time to time by posting a revised version and updating the “Last Updated” date. Your continued use of the Services after changes take effect constitutes acceptance.
